What are the key changes I need to know about?

Until the end of 2020, the UK has been covered by EU Cosmetics Regulation 1223/2009. Following the departure of the UK from the EU (and the transition period), from 1 January 2021, the UK will have be regulated by the Office for Product Safety and Standards (OPSS). There are many similarities to the EU regulations, but there are some key actions you must take:

  • Check the details of your Responsible Person
    If you sell your product in the UK, the RP MUST have a UK physical address
    If you sell your product in Europe, the RP MUST have a physical address in Europe
  • Add details of your product on the GB notification portal.
  • Check your label. Your label will need to include new Responsible Person details (if relevant) and country of origin, where needed.
  • If you are making cosmetic products available to consumers in Great Britain (GB: England, Scotland, and Wales), you must notify your cosmetic products using the “Submit cosmetic product notifications” service.
  • There is a separate process for placing cosmetic products on the market in Northern Ireland.
