Brexit

What are the key changes I need to know about?

Until the end of 2020, the UK has been covered by EU Cosmetics Regulation 1223/2009. Following the departure of the UK from the EU (and the transition period), from 1 January 2021, the UK will have be regulated by the Office for Product Safety and Standards (OPSS). You can read more here. There are many similarities to the EU regulations, but there are some key actions you must take:

  • Check the details of your Responsible Person
If you sell your product in the UK, the RP MUST have a UK physical address
If you sell your product in Europe, the RP MUST have a physical address in Europe
  • There is a new GB notification portal
  • Check your label. Your label will need to include new Responsible Person details (if relevant) and country of origin, where needed.
  • If you are making cosmetic products available to consumers in Great Britain (GB: England, Scotland, and Wales), you must notify your cosmetic products using the “Submit cosmetic product notifications” service.
  • Access the new portal here.
  • There is a separate process for placing cosmetic products on the market in Northern Ireland.

No. Northern Ireland remains covered by the EU Cosmetics Regulation, specified in the Northern Ireland Protocol.
